2022 Session Bills

Bill – STATEMENT OF PURPOSE – RS29201 / H0460
This legislation would end all legal abortion in Idaho, without exception. It provides legislative intent, repeals a section of Idaho code that prohibits the prosecution of abortion as murder, defines terms, directs the Attorney General to enforce State law regardless of any contrary court opinions, and provides prosecuting discretion. This legislation asserts Idaho’s lawful authority to ignore the Federal Judiciary’s unconstitutional abortion jurisprudence.

Bill – STATEMENT OF PURPOSE – RS29214 / H0521
The purpose of the proposed legislation is to delete outdated language in Idaho Code § 18-608

Resolution 19 – STATEMENT OF PURPOSE – RS29288C1 / HR019
This legislation states findings of the Idaho House in regards to abortion in Idaho and in regards to the abortion opinions of the Supreme Court of the United States. The legislation encourages the Supreme Court to reverse its Roe v. Wade decision in an abortion case it is considering in its current term.

2023 Session Bills

Bill – STATEMENT OF PURPOSE – RS30476 / H0242
This legislation adds a section in the chapter of the Idaho Code relating to abortion. The legislation adds definitions related to the illegal trafficking of minors to procure a criminal abortion and amends the section of Idaho code dealing with criminal abortion by prohibiting anyone from trafficking a minor for a criminal abortion with the intent of concealing the crime from the minor’s parents. This legislation authorizes the state Attorney General to prosecute at their discretion for a crime committed under the section governing criminal abortions. The legislation provides for civil remedies.

Bill – STATEMENT OF PURPOSE – RS30723 / H0342
This legislation amends Idaho Code, Section 18-622 to eliminate the trigger provision and change the affirmative defense structure of the law into an objective standard. Specific exceptions with regard to life threatening conditions are also further defined. The legislation also provides additional clarifying language with regard to the reporting standard on rape and incest.

This legislation amends Idaho Code, Section 18-622 to clarify our existing definition of abortion and it eliminates the trigger provision and affirmative defense. The legislation also provides additional clarifying language regarding the reporting standard on rape and incest.

2024 Session Bills

Proposed Bill – RS31481 / H0721 – 03/19 Introduced, read first time
This legislation amends §18-608, §18-8705, §18-8706, §18-8707 and repeals section §18-623 and chapter 88title 18 in its entirety. The proposed legislation repeals the various abortion bans that have been passed by the Idaho Legislature since 2019 assigning criminal liability to medical professionals and others, including the 2020 abortion trigger ban, the 2021 6-week abortion ban, the 2022 bounty law and the 2023 abortion travel restrictions. It protects health professionals from facing prison time or monetary penalties for providing responsible reproductive healthcare, protects access to safe abortion prior to fetal viability, and allows women facing health crises or otherwise carrying a non-viable fetus to obtain medically necessary or recommended abortions. No public funds would be allocated for any form of abortion care in the state of Idaho.
